JakartaBicara, Jepara – Dewan Pimpinan Daerah Koalisi Kawali Indonesia Lestari (DPD Kawali) Kabupaten Jepara, melakukan audiensi dengan para pihak terkait perijinan dan kerusakan lingkungan yang menjadi sebab permasalahan di Karimunjawa, Kawali bersama tokoh masyarakat, pelaku wisata, BEM FPIK (Fakultas Perikanan dan Ilmu Kelautan) UNDIP dan LSM AKAR (Alam Karimun) Karimunjawa.
Audiensi dilangsungkan di Ruang Serbaguna DPRD Jepara. Rabu, (25/5/2022).
Dalam audiensi kali ini dipimpin oleh Wakil Ketua DPRD Pratikno, yang didampingi Komisi D Sutrisno dan Sunarto, turut hadir Balai Taman Nasional Karimunjawa, Badan Pertanahan Nasional, Dinas Penanaman Modal Dan Perizinan Terpadu Satu Pintu (DPMPTSP), Dinas Lingkungan Hidup Kabupaten, Dinas PUPR, kepala Desa Kemujan, Kecamatan Karimunjawa, Pelaku Wisata, perwakilan masyarakat Karimunjawa, Satpol PP, serta OPD terkait.
Ketua DPD Kawali Jepara Tri Hutomo dalam pemaparannya menyampaikan 3 pokok pembahasan, salah satu diantaranya yaitu dampak perijinan pembangunan Startup Island Karimunjawa di Desa Kamujan, dengan dibangunnya Stratup Island oleh PT LHI tanpa melalui tahapan sesuai regulasi, tanpa kajian awal dan mengabaikan dokumen lingkungan dalam kegiatan pembangunan maka berbagai persoalan sosial dan lingkungan bermunculan.
Sengketa lahan sudah muncul dari awal antara PT.LHI dengan warga sekitar sebagai dampak sosial. Seperti diketahu bersama bahwa pada tanggal 14 Mei 2022 telah dilakukan pengukuran ulang yang diprakarsai oleh Andi Kristiandi yang masih menjabat Bupati Jepara waktu itu, melalui Dinas PUPR Jepara. Dalam audensi terungkap fakta bahwa pengukuran ulang yang telah dilakukan dan disampaikan Andi Kristiandi di publik adalah tidak benar, karena faktanya menurut keterangan dari BPN yang hadir
“ Kami hanya melakukan penelitian atas sengketa lahan sesuai surat tugas tertanggal 13 Mei 2022 atas dasar permintaan dari Dinas PUPR Jepara, jadi bukan pengukuran ulang dan bukan melalui permohonan resmi dari para pihak yang bersengketa” terang pihak BPN “
Sementara Kepala Desa Kemujan Muhammad Ilyas mengatakan, “ bahwa pihak BPN dalam melakukan pengukuran tanah tidak melibatkan pihak-pihak terkait yaitu pemilik tanah yang berbatasan , bahkan Kepala Desa pun tidak dilibatkan, Pihak Desa diundang setelah pengukuran tanah selesai” terang Ilyas”.
Dengan permasalahan sengketa lahan tersebut, Kawali Jepara sama sekali tidak tau adanya pengukuran ulang batas lahan, padahal kami adalah pihak yang diberikan Kuasa resmi oleh masyarakat yang lahannya diduga masuk dalam wilayah pembangunan Startup Island oleh PT LHI. “terang Tri Hutomo Ketua Kawali”
Lebih lanjut Ketua Kawali Jepara mempertanyakan akan keabsahan yang diklaim sebagai pengukuran ulang oleh Andi Kristiandi (penjabat Bupati waktu itu), apakah penelitian tersebut ada dasar hukumnya dan hasilnya bisa dipertanggungjawabkan di depan hukum. Penelitian yang dilakukan oleh BPN atas permintaan Dinas PUPR Jepara tersebut bukan melalui permohonan resmi dari para pihak yang bersengketa, jika karena adanya sengketa secara otomatis harusnya menghadirkan para pihak yang bersengketa atau pemilik lahan yang berbatasan obyek sengketa. Tapi faktanya yang diklaim pengukuran tersebut dilakukan hanya sepihak saja atas dasar isntruksi dari Bupati waktu itu, jadi jelas itu suatu kegiatan ilegal. “Jelas Tri”
Tri juga mengatakan, “Harapan kami dengan melakukan audensi bersama dengan pihak-pihak terkait permasalahan permasalahan yang ada di Karimunjawa, akan segera mendapatkan kejelasan dalam solusi, tindakan atas pelanggaran, maupun kepastian hukum.
